Greek magazine publisher faces charges

(AP) ? Police have arrested the publisher of a magazine that printed what is it says is a list of more than 2,000 Greek depositors at an HSBC bank in Switzerland.

Costas Vaxevanis, the publisher of Hot Doc magazine, will face a court hearing Monday, charged with the misdemeanor of violating laws regarding personal data, police said.

On Saturday, he published what he claims is a list given to the Greek government by French officials in 2010.

Information on 24,000 HSBC customers with Swiss accounts were stolen that year, the British bank has said, potentially exposing many international clients to prosecution by tax authorities, if they failed to declare the assets in their home countries. The bank said a former IT employee with HSBC, identified by French authorities, had obtained the information.

A Penn State University cheerleader who plummeted five stories from a window could be permanently brain damaged, her family?s rep told RadarOnline.com in an exclusive interview.

Paige Raque fell 39 feet from the off-campus apartment where she lives during a party on Saturday night and suffered severe brain injuries and a fractured pelvis.

She remains in critical condition.

The 19-year-old ?die-hard Penn Stater? was flown to Altoona Regional Health System and is still in intensive care, according to Yahoo! Sports.

On Tuesday, sophomore Paige, from Louisville, Kentucky, showed a ?slight improvement? and opened her eyes for the first time - but was back to being sedated by Wednesday and is resting, said Randy Jepson, head coach of the Penn State men?s gymnastics team and the Raque family?s spokesperson.

Speaking exclusively to RadarOnline.com Jepson said that it was too soon for doctors to know if Paige?s head injuries could result in permanent brain damage.

He said: ?It?s too early to say if Paige will be permanently brain damaged or the severity of any possible brain damage.

?It?s a very slow process and because her injuries are so dramatic the doctors have to take it day by day.

?Yesterday was a very busy day for Paige ? she had a lot of visitors and doctors attending to her ? so today she is resting and is sedated again.

?But she is still in a critical condition.?

The events surrounding the fall are still unclear but authorities have said it was an accident.

Jepson, who coaches Paige?s older brother Parker, the Penn State men?s gymnastics team captain, also said that it was normal that she was less responsive today.

He said: ?The doctors said that the fact Paige is responding less today is completely normal with these types of injuries.

?It?s remarkable that the only broken bones she has is a fractured pelvis.?

When asked if Paige had been drinking at the party, Jepson said: ?I can?t speculate about that and I can?t speculate about what actually happened that night.?

Paige?s brother Parker is keeping friends and family updated via his Twitter page.

He Tweeted Wednesday morning: ?With some family and friends this morning praying for Paige! Jesus said 'Do not be afraid; just believe, and she will be healed.'"

CNBC: Google Has Been Calling Analysts - Business Insider

Based on a report that aired on CNBC a few moments ago, there may be a bigger scandal with Google earnings than their accidental premature release.

CNBC's Jon Fortt reported that, according to conversations he's had with people in the financial community, Google "has been calling around for the past couple of days trying to prepare analysts for this report not to look so great?trying to skew their attention towards certain numbers that might not make this look as bad as it does right now."

Fortt continued, saying, "The fact that they knew this report was going to be an issue, combined with this error apparently on R.R. Donnelley's side is creating quite an issue for them internally."

Google has been calling analysts to warn them it would have a bad quarter?

Uh oh. That's a no-no.

Calling analysts to try to reduce "expectations" in advance of a weak quarter was something that companies did routinely in the 1990s, before the enactment of Regulation FD, which explicitly prevents such communications.

Tipping off an analyst to forthcoming results, whether explicitly or implicitly, is unfair to any investor or analyst who isn't privy to such information.

So if this really happened?if Fortt's sources aren't just relaying rumors or trying to sound smart and in-the-know in the wake of a disappointing earnings report?Google may have a bigger scandal on its hands than its bizarre early earnings report.

*UPDATE: CNBC's John Fortt returned to the air about an hour after his initial report to clarify his remarks. He said that Google had not called analysts to give "guidance" about the quarter.

Now, companies can give different kinds of guidance, from explicit numbers (which, these days, are generally published?except in Facebook's IPO) to suggestive comments about how an optimistic analyst might want to factor such-and-such a concern into his or her estimates, and so forth.? We thought that this might have been what happened here. But a source familiar with Google's investor-relations practices tells us that Google does not give this kind of "soft" guidance, either.

Attorneys To Release Confidential Boy Scouts Files On Alleged ...

(CNN) ? More than 20,000 confidential Boy Scout documents will be released Thursday identifying more than 1,000 leaders and volunteers banned from the group after being accused of sexual or inappropriate conduct with boys.

The public release of the Scouts? 1,247 ?ineligible volunteer files? from 1965 to 1985 will not contain the identities of the boy victims and witnesses. The national files are being distributed with the approval of the Oregon Supreme Court by a law firm that won an $18.5 million judgment in 2010 against the Boy Scouts in a case where a Scoutmaster sexually abused a boy.

Wayne Perry, president of Boy Scouts of America, said the group is deeply committed to youth protection, but he acknowledged that in some cases, the organization?s response to allegations of abuse by volunteers ?were plainly insufficient, inappropriate or wrong.?

?Where those involved in Scouting failed to protect, or worse, inflicted harm on children, we extend our deepest and sincere apologies to victims and their families,? Perry said in a statement issued Wednesday evening. ?While it is difficult to understand or explain individuals? actions from many decades ago, today Scouting is a leader among youth-serving organizations in preventing child abuse.?

The Boy Scouts opposed the release of the internal records and said their confidentiality has encouraged prompt reporting of questionable behavior and privacy for victimized boys and their families.

?While we respect the court, we are still concerned that the release of two decades? worth of confidential files into public view, even with the redactions indicated, may still negatively impact victims? privacy and have a chilling effect on the reporting of abuse,? the organization said.

The Scouts also released a September report from a University of Virginia psychiatry professor, Janet Warren, who concluded that the system ?has functioned well in keeping many unfit adults out of Scouting.?

But the attorneys representing victims in several lawsuits against the Scouts say the group hid evidence from the public and police and that the so-called ?perversion files? offer insight into what they deem a serious problem in the organization.

The secrecy protected more than 1,000 suspected child molesters, said the attorneys, who will publicly release the documents during a news conference in a downtown Portland hotel. The attorneys are also seeking the release of post-1985 files from the Boy Scouts.

The files will show that the expelled Scout leaders and volunteers ? all men ? ?are sociopathic geniuses,? said attorney Kelly Clark of Portland, who has reviewed the 20,000 pages and is among the attorneys releasing the papers Thursday.

?They fool everybody,? he said. ?And then they are able to coerce, convince or threaten these kids to stay silent. And you see that play out over and over again in the files.?

Clark said he represents more than 100 men who as children were in the Boy Scouts, and he estimates that more than 50% of his clients have drug or alcohol problems. At least three of them have committed suicide, he said.

Tim Kosnoff, an attorney in Seattle, said the abuse allegedly inflicted on the men as boys ?has a corrosive effect? in which trust, relationship and sexuality issues develop with adulthood.

One former Boy Scout represented by Kosnoff, Keith Early, joined the group at 12, recruited by an assistant Scoutmaster who was a married firefighter with three children and led Scout meetings in a church in Washington state.

Early, now 18, was sexually abused by the Scout leader while helping build a Boy Scout camp on his 42-acre ranch, he said in an interview with CNN. The assistant Scoutmaster was convicted of abusing Early and another boy and is now serving a prison sentence of 10 years to life.

?I felt like I was all alone,? Early said. ?Just thinking about it makes me angry ? because how could you do that to somebody? How could you bring yourself to do that to somebody who is so innocent and has done nothing wrong??

The number of files started each year ranged from 25 to 75 at a time when about 5 million Scouts and volunteers were active, according to Warren?s report. In most cases, ?police, courts and public were aware of the information in the files,? and 58% ?included information known to the public.?

There were ?a small number of files where an alleged offender was allowed back into Scouting after offending,? often after psychiatric treatment, ?those cases were extraordinarily rare,? wrote Warren, who was an expert witness for the Boy Scouts during the court case.

Tim Hale, a Santa Barbara, California, attorney who?s representing allegedly abused Scouts who are now adults, said the released documents could provide information about possible pedophiles.

?We?re talking about hundreds, if not thousands, of unidentified men who should be registered sex offenders who are roaming free in society, free to volunteer with other youth organizations, to work at schools and that sort of thing,? Hale said.

The Boy Scouts disputes that characterization of their files.

In a September 20 statement released by the Boy Scouts, Warren rebutted the characterization that the documents were ?secret files of hidden abuse? by pedophiles.

?The files show a significant amount of public knowledge of the offenders and their unlawful acts. For example, over 60% of the files being made available to the public include some kind of public information. These public domain sources included newspaper articles, police reports, criminal justice records, and records of civil litigation. The majority of men in the files were arrested at some point in their lives for a sex crime,? Warren wrote.

The files are also ?very limited in their ability to answer important research questions about sexual abuse,? she said.

?While some have attempted to categorize these files as a ?treasure trove? of information about pedophiles and their actions, that simply is not the case,? Warren said. ?These files tell us precisely what researchers already knew, and have known for many years: some small number of men will use a position of trust and access to young people to pursue illegal sexual gratification. This is a sad reality that has been with us throughout human history.?

The Boy Scouts say they have improved their youth protection policies the past decade and have initiated such practices as third-party, computerized background checks on all new adult volunteers. Also, at least two adults are present at all scouting activities, the group said.

The Scouts, founded by congressional charter in 1910, instituted character reference checks for Scoutmasters in 1911 and, by the 1920s, began using an ineligible volunteers list deemed not having ?the moral, emotional or character values for membership,? the group said.

In June, the Oregon Supreme Court upheld a lower-court decision to release the documents as requested by media outlets.

?The court had discretion to order, on good cause shown, the release of those documents subject to the redaction of names set out in the exhibits to protect victims of child sexual abuse and reporters of child sexual abuse from embarrassment, retaliation or other harm,? the state Supreme Court said in its order. ?The court in this case properly exercised that authority.?

The media companies seeking the release of the files were the Associated Press, The Oregonian newspaper in Portland, Oregon Public Broadcasting, KGW (a CNN affiliate), The New York Times and Courthouse News Service.

Those media outlets intervened in a 2010 lawsuit in Oregon that resulted in the largest judgment against the Scouts in a molestation case.

That year, an Oregon jury found the Boy Scouts liable for the sexual abuse of a 12-year-old boy more than 25 years earlier, returning a verdict of $18.5 million in punitive damages.

The plaintiff, Kerry Lewis, then 38, allowed his name to be used publicly during the trial, according to his attorneys. He was among six men suing the Boy Scouts over allegations of sexual abuse.

Lewis? attorney, Clark, produced documents during the six-week trial that he said were part of an archive of previously secret Boy Scout files chronicling decades of abuse of boys.

Clark said that when his clients were boys during the 1980s, the Boy Scouts knew that at least one of them had been abused by a former assistant Scoutmaster. At the time of the 2010 trial, that former assistant Scoutmaster was a 53-year-old convicted sex offender released from prison in 2005 and paroled until 2013.

Clark also alleged that though the Scout leader was removed, he was allowed to stay on as a volunteer and the abuse continued. In 1983, the assistant Scoutmaster told troop leaders he abused 17 Scouts, according to plaintiff?s attorneys.

In its verdict, the jury held the Boy Scouts of America 60% negligent; the Cascade Pacific Council, which oversees Scouting activities in the region, 15% negligent; and the Church of Jesus Christ of Latter-day Saints 25% negligent.

The church has sponsored a number of Boy Scout troops, including the one to which the plaintiff belonged. A lawyer representing the church said then that the verdict had no impact on the church, because it settled the case out of court more than a year earlier.

Judge sides with DC Comics in fight over Superman

LOS ANGELES (AP) ? DC Comics will retain its rights to Superman after a judge ruled Wednesday that the heirs of one of the superhero's co-creators signed away their ability to reclaim copyrights to the Man of Steel roughly 20 years ago.

The ruling means that DC Comics and its owner Warner Bros. will retain all rights to continue using the character in books, films, television and other mediums, including a the film reboot planned for next year.

DC Comics sued the heirs of artist Joe Shuster in 2010, seeking a ruling that they lost their ability to try to reclaim the superhero's copyrights in 1992. U.S. District Court Judge Otis Wright II agreed, stating that Shuster's sister and brother relinquished any chance to reclaim Superman copyrights in exchange for annual pension payments from DC Comics.

Shuster and writer Jerry Siegel created Superman, who made his comic book debut in 1938 in Action Comics (hash)1. Both men battled for increased compensation for the superhero throughout their lives and Siegel's heirs have also fought DC for a stake in copyrights to Superman.

Shuster's heirs had argued that the copyright agreements could be terminated under provisions that allowed creators of works made before 1978 a mechanism to reclaim their rights. Wright ruled that the decision by Shuster's sister to accept higher annual payments created a new agreement and the pre-1978 rights no longer applied.

"We respectfully disagree with its factual and legal conclusions, and it is surprising given that the judge appeared to emphatically agree with our position at the summary judgment hearing," the Shusters' attorney Marc Toberoff wrote in a statement. He declined further comment, and Warner Bros. and its attorney Daniel Petrocelli also declined comment on the ruling.

Toberoff had argued that an agreement altering copyright interests would have been much longer than the one-page 1992 agreement between DC Comics and Shuster's sister, Joan Shuster Peavy, and his brother, Frank.

The latest Superman film, "Man of Steel" is scheduled to land in theaters in 2013. Director Zach Snyder told fans earlier this year at Comic-Con that his film would make the superhero more relatable than previous depictions that showed him as "a big blue Boy Scout up on the throne and you can't really touch him."

In April, the $412 check that DC Comics wrote to acquire Superman and other creative works by Shuster and Siegel sold for $160,000 in an online auction.

The fine folks at BlendTec have continued their fine heritage of appliance-based science by seeing whether or not the Samsung Galaxy S3 or the iPhone 5 are able to survive industrial-strength spinning blades. The short answer is no, neither of them can withstand BlendTec's whirling wrath, but as you can see from the video below, the Galaxy S3 manages to stay mostly in one piece longer than the iPhone 5. Some other decidedly more practical (though less scientific) toughness tests have show that the SGS3 doesn't fare quite as well against the iPhone 5 in drop tests

Amid the worst recession in decades, key future tenants ? among them, luxury retailers Neiman Marcus and Nordstrom ? bailed from the $315 million project, even as online shopping dug deeper than ever into traditional brick-and-mortar sales.

But now, a partnership between Taubman Centers Inc. and Manatee County's Benderson Development Co. plans to break ground Monday on a 276-acre parcel that will likely become the most upscale retail center between Tampa and Naples. In doing so, the mall's co-developers won't just resurrect a project left for dead ? the largest among dozens scuttled by the Great Recession. It will likely transform Southwest Florida shopping.

?High-end malls like this are very unique, especially now,? said Frank Falciani, senior vice president of Pittsburgh-based dck worldwide, which has built similar projects for Taubman and others and will work on University Town Center. ?There is not going to be anything quite like University Town Center in the southwest part of the state.?

The mall's size ? 880,000 square feet, with more than 100 merchants ? is expected to be matched by a level of extravagance this region has never seen. In many ways the project will mimic what Michigan-based Taubman has done in Tampa with its International Plaza, anchored by Neiman Marcus and Nordstrom, and at Orlando's Mall at Millenia, a Taubman property with another Neiman Marcus and a Bloomingdale's among its key merchants.

Anchored by department stores Saks Fifth Avenue, Macy's and Dillard's, this area's first new mall in nearly four decades also signals renewed confidence in a regional economy that has struggled mightily since the first Mall at University Town Center plan was shelved.

Additionally, the project's construction at University Parkway and Interstate 75 is expected to spark an eventual paradigm shift, drawing residents and tourists away from traditional shopping hubs downtown, at St. Armands Circle and at the pair of malls that have dominated retailing here for decades.

But that shift will not likely occur until months, or even years, after the new mall's scheduled opening sometime in late 2014.

?Trying to change a longstanding shopping pattern isn't going to be easy,? said Jeff Green, a Phoenix-based retail consultant who has done extensive work in Southwest Florida. ?I believe there is a psychological barrier between those who live on the coast and all that retail so far east.

?The drive feels a lot longer than it probably is, but when it comes to shopping, perception is reality.?

A select group

University Town Center will become only the second mall nationwide in any phase of construction this year, following the March opening of City Creek Center in Salt Lake City.

Though developers are expanding some properties in New York and elsewhere, and new malls plans are getting underway in places like Hawaii, traditional mall building has been scarce. Before the Utah property's opening, a new enclosed mall ? save for discount outlet centers ? hasn't been built since 2006, according to data collected by the Directory of Malls, which has been tracking properties since the 1970s.

?It is a good sign for the economy that malls are moving forward. They employ a lot of people,? Green said, adding that Taubman's decision to proceed with University Town Center is extraordinary, too, because of its location. ?It is strange that it is happening in Florida, as opposed to markets that haven't been hit by the recession as hard.?

Neither Taubman nor Benderson officials would comment on the project ahead of the planned Monday groundbreaking.

When completed, the University Town Center mall will be only 12 miles from the nearest existing enclosed center, Westfield Corp.'s Southgate Mall.

But it will likely shift the epicenter of shopping in Sarasota and beyond away from existing nodes to one that has only recently been developed, near Interstate 75 and the master-planned community of Lakewood Ranch.

There, Benderson has aggressively built or expanded several strip centers and a former outlet mall, adding merchants like Marshall's, The Fresh Market, Kohl's, Sports Authority and others to a roster that had included a Home Depot and BJ's Wholesale Club.

In advance of the mall that is now getting under way, Benderson also lured a SuperTarget, category killers like Best Buy and Total Wine, and a host of smaller specialty tenants, restaurants and service firms.

Taken together, the new stores are intended to capture retail traffic that had traditionally limited shopping to Tamiami Trail in either Bradenton or Sarasota.

?The mall is just the icing on the cake for that intersection,? said Dale Scott, Florida director of the International Council of Shopping Centers, a trade group, and senior executive vice president of Deerfield Beach-based Sikon Construction. ?People will be willing to drive there for that kind of retail selection.?

Some shoppers will have to drive farther than others because the mall is expected to siphon shoppers from as far as Longboat Key and Casey Key, another exclusive residential enclave that lacks upscale stores.

But it is the growing, affluent suburban developments in Lakewood Ranch, and others nearby in Manatee and Sarasota, that are the primary targets for University Town Center.

Falciani, the dck worldwide executive, noted that Taubman ? as well as sophisticated merchants like Saks ? has done extensive market research and demographic studies to map out who will shop at the new mall and how far people will be willing to travel.

?Taubman is very selective about where they are going to build, and I think the recession has only made them more selective,? Falciani said.

Other analysts question not whether the mall will draw shoppers, but how frequently.

?The appeal is there for the residents who live in that area, but the affluence comes from those who live west in the city,? Green said, pointing to wealthy neighborhoods west of Tamiami Trail in Sarasota.

?By developing so much in one area, they're banking on the risk that customers will be willing to pass by other retail concentration to find better shopping,? Green said. ?They will do it, but the question is how often??

There appears to be little debate that the new mall will compete with existing properties and concentrations of stores throughout Southwest Florida.

?The new mall is going to cannibalize the existing malls in the beginning, that's for sure,? said Scott, the International Council of Shopping Centers director. ?They may struggle to find their niche, but there is enough to go around in the south Sarasota and downtown Sarasota market.?

University Town Center also may influence the types of merchants that come to populate existing retail nodes. In place of apparel-themed fashion stores, Green and others contend that nontraditional retailers will fill in a void that the newest mall creates.

To a degree, that transformation toward more mixed-use centers is already happening. In August, for example, Costco Wholesale Corp. opened a members' discount club in Westfield's Sarasota Square Mall on South Tamiami Trail ? space that had been a Dillard's department store.

?Value is king in today's market,? said Howard Davidowitz, chairman of Davidowitz & Associates Inc., a New York-based retail consultancy and investment banking firm. ?It's what shoppers want, so companies are investing in that.?

Although Westfield has flirted for years with the concept of renovating and expanding its Southgate Mall ? a former strip center at South Tamiami Trail and Siesta Drive in Sarasota ? it has never gone forward.

Ironically, the loss of its Saks anchor in two years may provide the impetus for Westfield to finally invest in Southgate, with new tenants, a new footprint, and even new concepts.

That, experts note, combined with its proximity to downtown, upscale neighborhoods and tourist hotels, is expected to keep Southgate a viable retail property, even with the new competition.

Notably, Westfield has yet to name a replacement for Saks at Southgate, and Macy's has been mum on whether it plans to stay in the 425,000-square-foot mall or exit along with Saks.

Starts and stops

The Mall at University Town Center was conceived during the mid-2000s housing bubble, a time of fervent discretionary spending before the stock market collapse and the recession.

At the time, the glitzy mall was believed to be the answer to a market largely underserved by tony retailers, despite wealthy demographics that matched Naples and even parts of Miami.

To the surprise of some, the project landed Neiman Marcus and Nordstrom ? even though both were tenants in Taubman's International Plaza. Saks was not invited to be one of the anchors.

Taubman came into the project through The Forbes Co., another upscale Michigan mall developer. But by 2008, Forbes had dropped out, citing the recession.

Benderson renewed its focus on strip centers, like the Target-anchored one it owns at Fruitville Road and Bahia Vista Street, and on acquisitions. Taubman, meanwhile, bided its time and concentrated on its existing portfolio.

For the next three years, the land where the Mall at University Town Center will be built sat fallow, as housing values plummeted and unemployment soared in Southwest Florida and nationally.

It was not the only retail-themed project to stay in the design phase.

Plans for Sarasota Bayside, a $1 billion mix of condominiums, stores, restaurants, offices and hotel rooms at the former Sarasota Quay eroded. Pineapple Square, a collection of shops and condos slated to transform downtown Sarasota, stalled ? though it has since made incremental progress with tenants including Brooks Brothers and Sur la Table. Other mixed-use projects heavy on retail, including a Benderson-owned site at Stickney Point Road, also faltered.

During the same period, online shopping grew in popularity, both among convenience-seeking customers and retailers fearful of making expensive inventory and lease commitments for new, physical stores.

?What stalled this mall for so long wasn't necessarily just the economy,? Green said. ?It was the retailers. No one wanted to commit to building new stores ? it was too early to build a mall. It might still be.?

By mid-2011 Benderson began making noises that the mall was not dead. Sarasota County commissioners once again blessed the concept, even without a prior commitment to building affordable housing nearby. The developer said while it would likely partner with another firm, Taubman was not yet on board again.

In late April, just weeks after Benderson patriarch and founder Nathan Benderson died at 94, Taubman announced its renewed involvement, and the trio of anchor department stores that would kick it off.

?We feel we have partnered with the premier mall developer in the country, with an ability to attract a great mix of fashion retailers,? Mark Chait, Benderson's executive director of leasing for the Southeast, said at the time.

?This is a market that is ripe for these types of tenants,? Chait said. ?This market is underetailed, and has been in need of this type of project for quite some time.?

Manageable risk

Though the mall may serve to fill a retail void, and experts say it is a tangible sign of the ongoing economic recovery, the development is not without risk.

?No one is building malls right now for a reason,? Davidowitz said. ?Stores are getting smaller and people are buying more online. I don't think retail will ever be the same.?

Between now and 2020, only 28 enclosed mall projects are scheduled to open in the U.S., according to the Directory of Malls.

But some analysts contend that Southwest Florida's unique demographics ? hundreds of thousands of tourists and more wealthy retirees per capita than in most regions of similar size ? make University Town Center different. They note that mall's freshness, combined with a gradual movement away from overbuilt strip and lifestyle centers, could benefit University Town Center.

?The mall is coming at a good time. By the time it is completed, it should be just fine,? said Rick McAllister, president and chief executive of the Florida Retail Federation trade group.

?The economy is slowly improving. Retailers are reporting a slow increase in sales every year,? McAllister said. ?Sarasota is an upscale area and I think the region can afford to support it. Moreover, new always wins. We as consumers like new and shiny things.?

But others note that Benderson and Taubman have failed to draw the exclusive retailers promised back in the early stages of the project. That could be mitigated if the pair is able to convince Nordstrom or a similar merchant to commit to being the mall's fourth ? and likely final ? anchor department store.

Nordstrom, which opened three new department stores last year, has been largely silent on the question. In July 2011, a company spokesman said only that there was a ?possibility? that the Seattle-based retailer would revisit opening an anchor in the mall. The company has been largely focused on developing its Nordstrom Rack concept, an outlet division.

This year, the chain planned to open 15 Rack stores but just a single full-line department store.

?Nordstrom is the next logical choice,? Green said. ?But I don't think they'll come until the mall is open and has matured some.?

Two Flawed Models of Health Insurance | Psychology Today

The modern era has inherited two models of health insurance: the fee-for-service model and the HMO model. Both models create perverse incentives for patients and their doctors.

Virtually all recent variations on these two models are attempts to ameliorate and control those perverse incentives?usually by introducing features that have a new set of perverse incentives. It is probably no exaggeration to say that the evolution of health insurance is one of cascading perversions, with each new wave of design trying to overcome the bad outcomes of the previous designs.

Under the fee-for-service model, insurance is designed to pay a separate fee for each service rendered, with patients responsible for some portion of the fee?in the form of a deductible, coinsurance or copayment amount. Under the HMO model, providers receive a fixed fee, irrespective of the amount of service rendered.

When healthcare is perceived as free (the HMO model), patients will have an incentive to consume it until its value at the margin approaches zero. Since the cost of care is well above zero, this implies that unconstrained patients will consume healthcare resources very wastefully. The deductibles and copayments that are features of a typical fee-for-service plan are only a small improvement on these distorted incentives. If patients pay 20 percent of the bill, for example, their incentive is to consume care until its value at the margin is worth only 20 cents on the dollar.

On the provider side, the fee-for-service model encourages overprovision?since more service results in higher income for the doctor, hospital or other supplier of care. The HMO model, by contrast, encourages underprovision, since any portion of the fixed fee that is not spent on medical care is available to the providers as take home pay or some other form of compensation.

Readers may wonder why either model was ever found appealing to anyone in the past. The short answer is that both models are the product of the technocratic approach to healthcare I discussed in Chapter 3 of my book, Priceless: Curing the Healthcare Crisis. Both, in other words, ignore economic incentives. Both models, for example, implicitly assume that (1) the amount of sickness is limited and largely outside the control of the insured, (2) methods of treating illness are limited and well defined, and (3) because of patient ignorance and asymmetry of information, treatment decisions will always be filtered by physicians, who will make decisions based on their own knowledge and experience or clinical practice guidelines. In this way, both models implicitly assume?one way or another?that economic incentives can be ignored.

However, an explosion of technological innovation and the rapid diffusion of knowledge about the potential of medical science to diagnose and treat disease have rendered these assumptions obsolete.

Although the HMO model is often viewed as the more contemporary, it is actually the less compatible with the changes the medical marketplace is undergoing. The traditional HMO model is fundamentally based on patient ignorance. The basic idea is a simple one: make healthcare free at the point of consumption and control costs by having physicians ration care, eliminating options that are judged "unnecessary" or at least not "cost-effective."

But this model works only as long as patients are willing to accept their doctor?s opinion. And that only works as long as patients are unaware of other (possibly more expensive) options.

As I have argued elsewhere, we could spend our entire gross domestic product on healthcare in useful ways. In fact, we could probably spend the entire GDP on diagnostic tests alone?without ever treating a real disease. The new reality is that patients are becoming as informed as their doctors?not about how to practice medicine, but about how the practice of medicine can benefit them. Combine the potential of modern medicine to benefit patients with a general awareness of these benefits and zero out-of-pocket payments, and the HMO model is simply courting disaster. The fee-for-service model is only a slight improvement.

Some believe that managed care and practice guidelines can solve these problems. Imagine grocery insurance that allows you to buy all the groceries you need; but as you stroll down the supermarket aisle, you are confronted with a team of bureaucrats, prepared to argue over your every purchase. Would anyone want to buy such a policy? Traditional health insurance isn?t designed to work much better.

Accordingly, I propose a new approach. It combines an old concept, casualty insurance, with two relatively new concepts: universal Health Savings Accounts (HSAs) (to control demand) and a proliferation of centers of excellence or "focused factories" (to control supply). I believe this is the approach that would naturally emerge if we relied on markets, rather than regulators, to solve our problems.

Skydiver lands smoothly after daring 24-mile leap

ROSWELL, N.M. (AP) ? Extreme athlete Felix Baumgartner landed gracefully on Earth after a 24-mile jump from the stratosphere in a dramatic, record-breaking feat that may also have marked the world's first supersonic skydive.

Baumgartner came down safely in the eastern New Mexico desert minutes about nine minutes after jumping from his capsule 128,097 feet, or roughly 24 miles, above Earth. He lifted his arms in victory, sending off loud cheers from jubilant onlookers and friends inside the mission's control center in Roswell, N.M.

"Sometimes we have to get really high to see how small we are," an exuberant Baumgartner told reporters outside mission control, shortly after the jump. He was expected to offer more remarks at an afternoon news conference.

The altitude he leapt from marked the highest-ever for a skydiver, though it wasn't immediately certain whether Baumgartner had broken the speed of sound during his free-fall, which was one of the goals of the mission. Organizers said the descent lasted for just over nine minutes, about half of it in free-fall.

Three hours earlier, Baumgartner, known as "Fearless Felix," had taken off in a pressurized capsule carried by a 55-story ultra-thin helium balloon. After an at-times tense ascent, which included concerns about how well his facial shield was working, the 43-year-old former military parachutist completed a final safety check-list with mission control.

As he exited his capsule from high above Earth, he flashed a thumbs-up sign, well aware that the feat was being shown on a live-stream on the Internet.

During the ensuing jump ? from more than three times the height of the average cruising altitude for jetliners ? Baumgartner was expected to hit a speed of 690 mph. He was believed to have reached speeds that exceeded 700 mph.

Any contact with the capsule on his exit could have torn his pressurized suit, a rip that could expose him to a lack of oxygen and temperatures as low as minus-70 degrees. That could have caused lethal bubbles to form in his bodily fluids.

But none of that happened. He activated his parachute as he neared Earth, gently gliding into the desert east of Roswell and landing without any apparent difficulty. The images triggered another loud cheer from onlookers at mission control, among them his mother, Eva Baumgartner, who was overcome with emotion, crying.

He then was taken by helicopter to meet fellow members of his team, whom he hugged in celebration.

Coincidentally, Baumgartner's attempted feat also marked the 65th anniversary of U.S. test pilot Chuck Yeager successful attempt to become the first man to officially break the sound barrier aboard an airplane.

At Baumgartner's insistence, some 30 cameras recorded the event Sunday. Shortly after launch, screens at mission control showed the capsule as it began rising high above the New Mexico desert, with cheers erupting from organizers. Baumgartner could be seen on video, calmly checking instruments inside the capsule.

Baumgartner's team included Joe Kittinger, who first attempted to break the sound barrier from 19.5 miles up in 1960, reaching speeds of 614 mph. With Kittinger inside mission control Sunday, the two men could be heard going over technical details during the ascension.

"Our guardian angel will take care of you," Kittinger radioed to Baumgartner around the 100,000-foot mark, and noted that it was getting "really serious" now.

An hour into the flight, Baumgartner had ascended more than 63,000 feet and had gone through a trial run of the jump sequence that will send him plummeting toward Earth. Ballast was dropped to speed up the ascent.

Kittinger told him, "Everything is in the green. Doing great."

As Baumgartner ascended in the balloon, so did the number of viewers watching on YouTube. Nearly 7.3 million watched as he sat on the edge of the capsule moments before jumping. After he landed, Red Bull posted a picture of Baumgartner on his knees on the ground to Facebook, generating nearly 216,000 likes, 10,000 comments and more than 29,000 shares in less than 40 minutes.

On Twitter, half the worldwide trending topics had something to do with the jump, pushing past seven NFL football games.

Among the tweets was one from NASA: "Congratulations to Felix Baumgartner and RedBull Stratos on record-breaking leap from the edge of space!"

This attempt marked the end of a five-year road for Baumgartner, a record-setting high-altitude jumper. He already made two preparation jumps in the area, one from 15 miles high and another from 18 miles high. It will also be the end of his extreme altitude jumping career; he has promised this will be his final jump.

Baumgartner has said he plans to settle down with his girlfriend and fly helicopters on mountain rescue and firefighting missions in the U.S. and Austria.

Poor parents not encouraging high school completion

ScienceDaily (Oct. 14, 2012) ? Parents from poorer backgrounds are less likely to encourage their kids to finish high school, according to a new analysis from the University of Melbourne.

About six in 10 children from low socio-economic households in Australia currently complete high school, while 90% of students from more affluent homes finish their secondary studies.

Lead researcher Dr Cain Polidano (0409 703 296), from the Melbourne Institute of Applied Economic and Social Research, said the attitudes of parents played a crucial role.

"Differences in the education aspirations of parents are probably the most important factor explaining the gap in school completion rates," he said.

The research found disadvantaged students were not only less likely to plan on completing high school (76% compared to 90% of better-off students), but they were also less likely to believe their parents want them to finish school (58% vs 73%).

"More importantly though, parents on lower incomes are more likely to favour vocational training courses -- which have no school completion pre-requisite -- over university courses," Dr Polidano said.

"Therefore, those parents may be more willing to let their children quit school.

"It seems many parents aren't aware that more than 95% of schools now offer their own VET courses."

Differences in the quality of schools on offer (including resources, governance, teachers and peers) is estimated to be relatively unimportant in explaining the completion gap.

But the study did find good quality teachers encourage disadvantaged students to remain in school, but have little effect on the retention of other students.

"This result underlines the particular importance of teachers in promoting a positive learning culture in low SES schools where academic achievement may not be the norm among students and their parents," Dr Polidano said

"These findings should help schools and politicians better focus policies aimed at closing the SES completion gap, which is vital to reduce inequality of opportunity."

According to a report published by Fight Hype, Filipino fight sensation Manny Pacquiao has signed an extension with Top Rank. Moreover, as per the report, part of the deal is that Pacquiao will face WBC welterweight titlist Floyd Mayweather Jr. next year.

?According to an eyewitnesses on the scene, Dena duBoef, Vice President of Marketing and the daughter of Bob Arum, escorted Pacquiao to a private room where he had a closed-door meeting with Arum, Koncz, and 50 Cent,? read the report. ?It's unclear as to exactly what was discussed, however, our source strongly believes that Pacquiao was given a verbal guarantee that, with the help of 50 Cent and Tommy Smalls, an April fight with Floyd Mayweather would indeed take place, convincing Pacquiao to sign the contract extension.?

Another source for the same added, ?He thinks he has that fight coming, but that fight isn't ever going to happen.?

For some reason, the fight between Pacquiao and Mayweather never happens. Even though Pacquiao has always been interested in facing the unbeaten American fighter, the latter always has issues with it.

In the very beginning, when the idea was born, Mayweather asked Pacquiao to go for random drug testing but the Filipino declined, claiming it was an embarrassment for him to prove he is not on drugs. Earlier this year, Pacquiao and Mayweather were in direct contact with each other, as Mayweather blamed Bob Arum, Top Rank?s promoter, for not being able to set the fight.

Mayweather asked Pacquiao to settle for a flat fee while he would keep the entire pay-per-view for the event. Again, for the Filipino, it was an embarrassing deal, since he believes both fighters are of the same calibre and he wants equal share.

Now, Pacquiao wants the fight more than anything, as he is on the verge of retirement. Fans have been demanding the fight for quite some time, and Pacquiao wants to give it to them before he leaves the sport. The Filipino has previously stated that even his 11-year-old son wants him to clash with the unbeaten American before he hangs up his gloves.

ANAHEIM, Calif. The American Association for Cancer Research will host the 11th Annual AACR International Conference on Frontiers in Cancer Prevention Research at the Hilton Anaheim from Oct. 16-19, 2012.

The conference will focus on both scientific and lifestyle strategies for preventing cancer. Hundreds of original scientific findings and premier lectures will showcase the state of the field.

To help plan coverage of the meeting, the AACR Communications and Public Relations Department has identified the following studies as being of potential interest to the media. Embargo times are noted on each release.

The following press conferences will be held in the San Simeon AB Room on the fourth floor of the Hilton Anaheim. Reporters who cannot attend in person can call in using the following information:

  • Compound's Dual Action Inhibited Oral Cancer
